ForMotiv Privacy Policy

General

For even the most strictly regulated websites, including healthcare, financial services, government, and technology – we adhere to enterprise-level security standards to help our customers ensure a secure environment for their data and meet their own compliance regulations.

ForMotiv maintains multiple relationships with Companies and Individuals.  The privacy policies for these are described in separate sections of this document.  The primary business of ForMotiv is to provide a Service to Customers to enable Customers to better understand behavior of Visitors to their Website.  The privacy policies for this relationship are described in the ForMotiv Service Privacy Policy.  As a business, ForMotiv also interacts with various individuals, including employees of Customers and prospective Customers.  The privacy policies for these relationships are described in the ForMotiv Website Privacy Policy.  

Terms

Where used in this document, the following terms will have the following specified meanings:

“Account” refers to the Customer’s account whereby Customer registers for and accesses the Service.

“Customer” means you, the individual or legal entity that you represent.

“Customer Data” means anonymous, aggregated data concerning the characteristics and activities of Visitors of the Customers’ Website(s) collected by the ForMotiv Javascript Library (ForMotiv Javascript), forwarded to the Servers, and analyzed by the Processing Software. The parties agree and understand that Customer intends to use the Service in a way that only anonymous information is collected from website visitors, so that no information collected can be used to identify individual website visitors’ PII.

“Documentation” means any documentation related to the Processing Software, including that which is available online or otherwise.

“ForMotiv Javascript” means the proprietary ForMotiv javascript library, which is installed by the Customer on a Website for the purpose of collecting Customer Data, together with any fixes, updates, and upgrades.

“PII” means Personally Identifiable Information which relates to any data that identifies or could potentially identify an individual.

“Processing Software” or “Software” means the proprietary ForMotiv server software, together with any fixes, updates, and upgrades, which process, analyze, and store the Customer Data.

“Report” means the analysis derived from Customer Data and made available through the Account. The charts, graphs, and statistics contained in a Report vary based on the type of account and plan.

“Servers” means the technological infrastructure controlled by ForMotiv (or its subsidiaries and/or subcontractors) upon which the Processing Software operates and the Customer Data and ForMotiv Javascript are stored.

“Service” means the facilities to analyze or parse Customer Data, from a Website owned, controlled, or operated by Customer.

“Software” means the FMJS, and Processing Software.

“Subscription” means the specific features, pricing, and attributes agreed upon by Customer and ForMotiv for the provision of the Software or Service or set forth in a separate contract.

“Visitor” means the person who access the Customer Website where Formotiv Javascript is installed and capturing information.

“Website” means a collection of one or more web pages that Customer owns and controls or operates or authorizes a third party to control or operate on its behalf.

ForMotiv Service Privacy Policy

This Privacy Policy applies to Services and the related Servers operated by ForMotiv on behalf of Customers to acquire and process Visitor behavioral information.  The policy explains what kind of information will be collected when a Visitor accesses a Customer Website on which the ForMotiv Javascript is installed, or when you access the ForMotiv Service.  The policy explains how this information will be used, shared, and how you can control the access, correction and/or deletion of this information.  We will not use or share your information with anyone except as described in this Privacy Policy. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources.  The use of information collected through our Service shall be limited to the purposes under this Privacy Policy and our Terms of Service to Customers.

Information We Collect Through the ForMotiv Service

When you or any Visitor visits a Customer Website, the ForMotiv Service may collect certain non-personal information about your behavior on the Website.  Data collected may include how you interact with your keyboard and mouse including keystrokes, click/touch, mouse movement, scroll and browser information such as browser model.  ForMotiv does not collect the actual data you type (or any personal information or PII).

Cookie Policy

ForMotiv does not use cookies in any way that allows the identification of specific visitors.  Cookies used by the ForMotiv Service are purely functional and are used to identify the activities of a particular session (series of Visitor interactions with your Website).  

Roles ForMotiv and Third-parties Play

Data collected through the ForMotiv Service about Visitor behavior on behalf of a Customer places the Customer as the Controller of the information, and ForMotiv serves as a Processor.  ForMotiv uses AWS services to process collected data as part of the service.  ForMotiv third-party vendors involved in this process are sub-processors.

Data Retention

Data collected by ForMotiv on behalf of a Customer is retained for a period of 10 years, unless otherwise requested by the Customer or where compliance with legal obligations may dictate a different retention period.  

Please notice that ForMotiv does not collect any personal information about individuals, therefore ForMotiv cannot identify which of the collected data belongs to a specific individual.  ForMotiv is therefore not able to delete data collected by the Service that may relate to an individual.

Third-party Vendors (Sub-processors)

ForMotiv uses AWS technology to store and process the information collected through the ForMotiv Service.  All Collected Information is encrypted both in flight and at rest and not accessible to the sub-processors.  ForMotiv has service agreements and measures in place that obliges to the applicable legislations.

Transfer of Data

Our ForMotiv employees and contractors in both EEA and USA might have access to the information collected by ForMotiv via the Service, only on a need-to-know-basis. ForMotiv has confidentiality agreements and measures in place with our employees and contractors that obliges them to the applicable legislations.  Please notice that ForMotiv does not collect any personal information about individuals.

Information We Collect in Conducting Business or in Providing Service

Once you are our Customer, you and ForMotiv might exchange communication over the subscription, support or Service.  For example, ForMotiv might send you information about new services or products.  We use third-party vendors (processors) who process this information on our behalf.  For example, we may communicate via e-mail using AWS or Google services.

To provide our Service, we do not acquire or use Identifiable or Personal Information about the Visitors to your Website.

Roles ForMotiv and Third-parties Play

For information you provided us with as our Customer, ForMotiv serves the role of Controller of such information, and our Third-parties are in the role of Processors.  ForMotiv has measures in place to guarantee all our third-party vendors provide the same level of protection to your data as we do at ForMotiv.

ForMotiv has service agreements and measures in place with the Processors that obliges them to the applicable legislations.

Information We Share with Third-party Vendors (Processors)

ForMotiv may use the services of third-party vendors (processors) to store and use the information that you provided us with in order to fulfill our Service.  For example, we use AWS and Google to send emails.  This information may include personal information such as the names, emails and phone numbers of your employees or contractors.  

ForMotiv has service agreements and measures in place with the third-party vendors (processors) that obliges them to the applicable legislations.

Data retention

The information provided by you will be retained for an undetermined period of time as ForMotiv wishes to save the business communication exchanged between our companies and also might have to comply with legal obligations such as proving it had collected your consent.

Any request to access, correct, amend or delete your personal information or any query you have about ForMotiv data retention policy should be sent to privacy@ForMotiv.com. We will acknowledge receiving your query within seventy-two (72) business hours and handle it promptly.

Opt-out From Communication

If not required by law or essential for our business relationship, individuals can opt-out from receiving communications. You can opt-out by:

– pressing the unsubscribe button in the email communication

– sending message to our Support Team

– sending an email to privacy@ForMotiv.com

We will acknowledge receiving your query within seventy-two (72) business hours and handle it promptly.

Transfer of Data

Our ForMotiv employees and contractors in both EEA and USA might have access to the information collected by ForMotiv from the ForMotiv website, only on a need-to-know-basis.  ForMotiv has confidentiality agreements and measures in place with our employees and contractors that obliges them to the applicable legislations. Please notice that ForMotiv does not collect any personal information about you, therefore ForMotiv cannot identify which of the collected data belongs to you. No information from the website visitors will be accessed by our third-party vendors (sub-processors).

Breach of Personal Data

In the event personal data is compromised as a breach of security, ForMotiv will promptly notify all Customers in compliance with the applicable law.

ForMotiv Website Privacy Policy

This Privacy Policy applies to websites operated by ForMotiv and explains what kind of information will be collected when you access this website, how this information will be used, shared, and how you can control the access, correction and/or deletion of this information.  We will not use or share your information with anyone except as described in this Privacy Policy. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources. Capitalized terms that are not defined in this Privacy Policy can be found in our Terms. The use of information collected through our Service shall be limited to the purposes under this Privacy Policy and our Terms of Service to customers.

Protecting the privacy of children is especially important for us. For that reason, ForMotiv does not knowingly collect or solicit personal information from anyone under the age of 13.  If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at privacy@ForMotiv.com. We will acknowledge receiving your query within seventy-two (72) business hours and handle it promptly.

Information ForMotiv Collects Ourselves

When you visit our website, the ForMotiv cookies collect non-personal information from your internet browser such as whether or not you are a first-time visitor.

Information ForMotiv Collects Through Third-parties

When you visit our website, third-party cookies, beacons, tags and scripts collect non-personal and aggregated information from your internet browser such as your behavior in our website.

Why do we use them? To create better online experiences, we get to know our users by analyzing trends and mouse movement around our website.

When you contact ForMotiv via website chat, email, online forms, you may provide ForMotiv personal information, including your name, email address, location or phone number.

We collect this information in order to reply to your queries or provide information of the service or product you requested.

When you book a demo or register as a Customer, you will provide Personal Information including: your name, email address, location or phone number.

When you purchase a service with us you provide our payment third-party vendors with information including:  your name, email address, location or phone number.

Once you are our Customer, we will store emails and messages exchanged between you and ForMotiv and between you and ForMotiv’s employees and contractors.

When you apply for a position with ForMotiv, you will provide Personal Information including: your name, email address, location or phone number.

Why do ForMotiv’s third-party vendors store this information on our behalf? This information is stored so ForMotiv can manage your account subscriptions, payments and provide you the best support while using our services.

Information you share from our website

When you share our blog posts in your social media pages you are taken to the respective social media page for log in and posting activities. ForMotiv is not responsible for the information you are posting or for the security of your login. Please, check the privacy terms of the respective social media page for further information.

ForMotiv retains customer’s business data for an undetermined period of time as ForMotiv might have to comply with legal obligations or resolve disputes.

Any request to access, correct, amend or delete your personal information or any query you have about ForMotiv data retention policy should be sent to privacy@ForMotiv.com. We will acknowledge receiving your query within seventy-two (72) business hours and handle it promptly.

Transfer of Data

Information you provided us with and the communication made through the ForMotiv Communication Systems will be stored within third-party vendors (processors) located in the European Economic Area (EEA) and in the United States of America (USA). Our ForMotiv employees and contractors in both EEA and USA might have access to them, only on a need-to-know-basis.  ForMotiv has service and confidential agreements and measures in place with our third-party vendors (processors), ForMotiv employees and contractors that obliges them to the applicable legislations.

When you click a link to go from a ForMotiv Website to another website, this Privacy Policy does not apply to the accessed website. In reality, this accessed website might have its own privacy policy.

We are not responsible for any practices employed by or the content within these websites linked to or from the ForMotiv Service or website.
